This Legal Notice and Terms of Use (hereinafter, "Legal Notice and Terms of Use") govern the access and use of the mobile application Playback and the internet portal (*) (hereinafter, "Application", “website "), owned by the company "Digital Media Technology, S.L.U.”
In compliance with the provisions of Law 34/2002, of July 11, on services of the information society and electronic commerce, we inform you that this application and website is owned by Digital Media Technology, S.L.U. (hereby “Adwake”), a Spanish company with CIF B66459660, registered and corporate address C/ Diputació 303 Tercera Planta, 08009 Barcelona – Spain.
Acceptance
Browsing, as well as simple access to the application and/or the mere use of the services offered through it, attribute the condition of user of this application (hereinafter, "user") and imply full and unreserved acceptance of the conditions included in this Legal Notice and Terms of Use, in the version published by Playback at the very moment the user accesses the application.
Playback reserves the right to unilaterally modify, at any time and without prior notice, the clauses of this Legal Notice and Terms of Use, as well as the configuration and, in general, any other content or service of its application. The use of the services and/or the simple access to the application will imply acceptance of any modification introduced. Therefore, Playback recommends periodically consulting this document, as well as its subsequent modifications.
Likewise, the use of the application is subject to all legal notices, regulations of use, or instructions made known to the user through this application and that replace, complete, and/or modify this Legal Notice.
Use of the application
Unless otherwise provided, the use of the application will be free of charge, without prejudice to the connection cost through the corresponding telecommunications network for the user to have access. The user is aware and voluntarily and expressly accepts that the use of the application is carried out in any case under their sole and exclusive responsibility. The user agrees to use the application as well as its services and content without contravening current legislation, good faith, generally accepted uses, and public order. Likewise, the use of the application for illicit or harmful purposes for Playback or any third party is prohibited.
During the use of the application, the user agrees not to carry out any conduct that could damage the image, interests, and/or rights of Playback and/or third parties or that could damage, disable, or overload the application, or that would prevent, in any way, the normal use of the application, computer equipment, or documents, files, and all kinds of content stored on any computer equipment of Playback, other users, or any other Internet user (hardware and software).
Intellectual and Industrial Property
All rights of industrial and intellectual property, as well as all information contained on the application (images, trademarks, graphic designs, source code, design, navigation structure, databases, and any other content that appears therein) are the exclusive property of Playback or, where applicable, are duly licensed by the owner. The names of other products, services, and companies that appear in this document or on the application may be trademarks or other distinctive signs registered by their respective and legitimate owners, without it being understood that access or use of the application attributes to the user any right over the aforementioned trademarks and other registered distinctive signs. Likewise, all information and content on the application are protected by copyright and the intellectual property rights thereof belong to Playback or, where applicable, their use and exploitation has been duly authorized by the owner, without any of the exploitation rights related to them being understood as transferred to the user beyond what is strictly necessary for the correct use of the application.
In the context described, the user is only authorized to view and obtain a temporary private copy of the contents for their exclusive personal and private use on their computer systems (software and hardware) and not be subsequently transferred to third parties. With the above exceptions, the user is expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available, extracting, reusing, resending, or using any nature, by any means or procedure, of any of them, except in cases where it is legally permitted or expressly authorized in writing by Playback and/or the owner of the corresponding rights. The unauthorized use of the information contained on this application, its resale, as well as the infringement of Playback’s industrial and intellectual property rights, will give rise to the legally established responsibilities.
The download and use of the Application do not imply a transfer of any ownership rights to the user, who is granted only a limited, non-exclusive license for personal use.
Limitation of Liability
Playback reserves the right to interrupt access to its application, as well as the provision of any or all of the content and/or services offered through it at any time and without prior notice, whether for technical, security, control, maintenance reasons, or any other cause.
Consequently, Playback does not guarantee the reliability, availability, or continuity of its application or the content offered therein, so access to said application and its contents by the user is at their own risk.
Likewise, Playback will not be liable for temporary interruptions of the service, delays, errors, malfunctions, and, in general, other inconveniences that originate in causes beyond Playback's control, and/or are due to the malicious or negligent actions of the user, and/or are caused by force majeure.
In this sense, Playback excludes itself, to the full extent permitted by law, from any liability for damages and losses of any nature that may be due to the lack of availability or continuity of the operation of the application and/or the services, to the fallibility of the application and/or the services, to failures in access to the different web pages of the application or those from which the services are provided.
Playback adopts reasonably adequate security measures to detect the existence of viruses and/or malware. However, the user must be aware that the security measures of computer systems on the Internet are not entirely reliable and that, therefore, Playback cannot guarantee the absence of viruses or other elements that may cause alterations in the user's computer systems (software and hardware) or in their electronic documents and files contained therein.
In this sense, Playback, to the full extent permitted by law, excludes any liability for damages of any kind that may be due to the presence of viruses or other elements in the contents of the application, which may cause alterations in the computer system, electronic documents and / or user files.
Finally, Playback assumes no responsibility for the use that the user makes of the contents of the application that may involve a violation of any type of national or international regulation, of intellectual or industrial property rights or any other right of third parties.
Both the access to the application and the use that may be made of the information contained therein is the sole responsibility of the user. Playback shall not be liable for any consequence or damage that may arise from such access or use of the information. Playback shall not be liable for possible security errors that may occur or for possible damages that may be caused to the user's computer system (hardware and software), files or documents stored therein, as a consequence of a malfunction of the browser or the use of non-updated versions thereof.
Playback shall not be liable for any damages arising from the use of the contents of the application. In particular, Playback shall not be liable neither for the contents nor for the condition of the links contained in this application that may lead the user to other sites and web pages managed by third parties. Playback is not responsible for the contents or the state of such applications and web pages. Access to them through this application does not imply that Playback recommends or approves their contents.
The Company shall not be liable for damages resulting from: (i) any incompatibility between the Application and the user's mobile device; (ii) technical failures, interruptions, or viruses originating from the mobile network or the App Store/Google Play Store; or (iii) unauthorized access to the user's device resulting from the user's failure to maintain device security (e.g., lack of passcode or jailbreaking).
Notifications
All notifications and communications (hereinafter, "notifications") from the user to Playback will be considered effective, for all purposes, when directed to the following email address: privacy@adwake.ai Likewise, all notifications made by Playback to the user will be considered validly made if they have been made using the data and through the means previously indicated. For these purposes, the user declares and guarantees that all data provided by them are true and correct and that they will keep them duly updated.
This application has been developed at all times in accordance with the principles of good faith by Playback. However, in the event that any third party considers that their intellectual and/or industrial property rights have been violated, they may notify it by means of a communication addressed to the aforementioned address of Playback.
Service Withdrawal and Suspension
Playback may withdraw or suspend at any time and without prior notice the provision of services offered through the application to those users who fail to comply with the provisions of this Legal Notice and Terms of Use.
Duration and Termination
The existence of the application, as well as the provision of the services offered therein, has, in principle, an indefinite duration. However, Playback is entitled to terminate or suspend the provision of the aforementioned services and cancel the application at any time, without prejudice to what may have been provided in this regard in the corresponding Particular Conditions. When reasonably possible, Playback will previously warn users about the termination or suspension of the application as well as, where appropriate, of the services offered therein.
Applicable Law and Jurisdiction
Any litigious issue related to the use of this application will be subject to Spanish law, with the Courts and Tribunals of the city of Barcelona being competent to resolve any questions that may arise or actions that may be brought derived from the provision of the services and/or contents of the application, as well as on the interpretation, application, compliance and/or non-compliance with what is established herein, unless an imperative rule establishes a different jurisdiction.
